HC: Not for us to dictate how KMC wards will be altered

The HC single bench had reasoned that it’s for state to decide “in what manner constituencies or KMC wards will be delimited or altered”

A resident under KMC limits, Dipu Das, had moved the vacation bench of Justice Hiranmay Bhattacharyya challenging the Sept 11 delimitation notice. The fresh plea in the HC division bench stated the application would lose relevance once the civic elections are announced. The HC division bench said since the petition has already been admitted, the petitioner retains the scope to approach the court at any moment if elections are announced. Kolkata: A plea was filed in the Calcutta High Court on Tuesday against the HC single-bench order refusing to pass any interim order of restraining authorities to call an election to the Kolkata Municipal Corporation based on delimitation–increasing wards from 144 to 209.

The HC single bench had reasoned that it’s for state to decide “in what manner constituencies or KMC wards will be delimited or altered”. “It is now settled that it is not for the court to dictate the manner in which the same would be done. If a delimitation exercise is carried out in conformity with the provisions of the relevant statute, and the constitutional provisions, and no breach of such provisions have been committed, the Court cannot interfere with the same,” the HC had held.
