Pointing out that former union minister M K Alagiri’s son Durai Dayanidhi is moving around and watching an IPL cricket match at a Chennai stadium and is also able to cast his vote with the help of others, a CBI court on Friday asked why he is not coming to court to answer the charges in a money-laundering case.
The judge said that the appearance of the respondent before the medical board is necessary to update his medical and physical condition for facing the trial. The second additional district court (CBI cases) in Madurai then referred him to JIPMER hospital in Puducherry for medical examination to determine his understanding capacity, soundness of mind and physical condition to defend his case. The court was hearing a petition filed by the Directorate of Enforcement seeking a direction to Durai Dayanidhi, an accused in a money-laundering case, to be examined by a medical board at AIIMS or JIPMER hospital in Puducherry to determine his present mental capacity to face criminal trial. The second additional district judge (CBI cases) in Madurai, S Shunmugavel, observed that the respondent had not completely denied that he did not go to M A Chidambaram stadium in Chennai to watch an IPL match between Chennai Super Kings and Delhi Capitals and also not completely denied that he had not cast his vote in the assembly elections. In his counter affidavit, he mentioned that he watched the cricket match with the help of others and that he also cast his vote during the assembly election. “If the respondent is moving and watching a cricket match in a stadium with the help of others and he is able to cast his vote with the help of others, why not the respondent coming to this court to answer the charge in this case? On seeing the activities of the respondent, especially attending to watch a cricket match at the stadium and going to cast his constitutional right of voting in the Tamil Nadu assembly election, the court feels that there is no impediment to go to medical test for his mental and physical ability to face the criminal trial before this court,” the judge observed. JIPMER hospital, Puducherry, is one of the reputed hospitals in India and it is run by Govt of India. There could be no influence by any of the parties to this case.

“The director of JIPMER hospital, is requested to take a decision regarding the admission of the respondent/accused Durai Dayanidhi in the hospital, if necessary,” he said. The judge observed that the director of JIPMER hospital is required to form the medical team constituting a chief psychiatrist, a clinical psychologist and a chief neurologist and is required to submit the report from the medical team after getting the clinical examination as early as possible. After examining the respondent and after receiving the report from the medical board, the director of JIPMER hospital is required to send the report directly to the court in a sealed cover as early as possible. Further, the respondent is directed to appear before JIPMER hospital as soon as he receives the information for a medical test and co-operate, the judge directed. Download the TOI App.
