Bengaluru: After Karnataka Industrial Areas Development Board claimed it has no litigation-free land measuring eight acres in a single parcel, Karnataka high court has directed authorities and KIADB to compensate a software company by paying 8% interest on its Rs 38 lakh deposit from Dec 2009 onwards.
The company approached Karnataka Udyog Mitra for setting up an IT park in Kadubeesanahalli, Varthur Hobli, Bangalore East, with an investment of Rs 43,000 crore. The application was approved by State-Level Single Window Clearance Committee on Oct 20, 2003, and a directive was given to the special land acquisition officer to acquire 8.5 acres of land and hand over the same. On Dec 11, 2003, the company was directed to deposit Rs 38.06 lakhs as 40% of the tentative cost of the acquisition proceedings, in order to enable the land officer to submit the draft of the notifications to KIADB for approval. The amount was deposited on Jan 27, 2004. Following a spree of litigation, the land officer, in Dec 2009, recommended dropping certain parcels of land from the acquisition.
A division bench comprising Justices DK Singh and H Shanthi Bhushan passed the order after a KIADB chief executive officer categorically stated that no unlitigated land was available at Defence & AeroSpace Park, Devanahalli, and Aveerahalli, Dobaspet Industrial Area 4th phase, for Brightsword Technologies’ project. The inspection and other formalities pertaining to the land were conducted.
On March 6, 2013, a single bench directed the authorities to provide alternative land to the company, along granting an option to claim damages from the state.
