Kolkata: A club cannot organise Durga Puja on the premises of a residential building without permission from the flat owners’ association, Calcutta High Court said on Tuesday, directing Muchipara cops to not grant permission to Sarad Sangha Club for holding the puja this year.
Five flat owners of a G+3 building at 133A, Raja Rammohan Sarani moved the single bench of Justice Saugata Bhattacharyya objecting to the organisation of Durga Puja by the club in the building’s common area.
They apprehended the club may “forcibly” hold the puja there. The club’s counsel submitted they have been organising the puja for a long period and after construction of the building, with permission of the erstwhile land owner, the club was organising Durga Puja at the car parking space. Additional Govt Pleader, representing state authorities, informed the court that, till date, no pandal has been erected on the premises.

“In the present case, nothing is demonstrated which would substantiate the case that said club has right to organise Durga Puja at the common area of the premises in absence of permission accorded by the flat owners’ association/individual flat owner,” the single judge held. Download the TOI App.
