Lucknow: The Lucknow bench of the Allahabad high court has quashed disciplinary proceedings against an IAS officer for giving “no objection” to a CBI closure report, holding that his action, in the absence of any mala fide or corrupt motive, could not be treated as misconduct.
It directed the authorities to restore all service benefits, including promotional and monetary entitlements, that he would have received, had the disciplinary proceedings not been initiated, within 12 weeks. A bench of Justices Alok Mathur and Amitabh Kumar Rai also quashed the charge sheet and all consequential penalty proceedings against IAS Rajesh Kumar Singh.

Singh was serving as joint secretary and chief vigilance officer in the department of heavy industry when he was directed to lodge an FIR with the CBI against MK Singh, then CMD of Bridge & Roof Co (India) Ltd, Kolkata.
