SL woman gets 60 days to hold valid marriage with Indian citizen, not to be deported
Madurai: Granting relief to a Sri Lankan woman who married an Indian citizen when she visited the country on tourist visa, Madras high court granted 60 days time to her to regularise their relationship by solemnising a valid marriage under any of the applicable statutory forms Counsel for Foreigners Regional Registration Officer, Bureau of Immigration, home ministry, submitted that Pavithra arrived in India on May 14 on the strength of an e-visa (tourist visa), which entitled her to stay in India for a month. Therefore, she should be deported, counsel said. The petitioner’s attempt was to violate the terms of the E-Travel Authority and had overstayed. Justice C Saravanan observed that several complications have arisen on account of the petitioner having breached the conditions of the tourist visa. Though Pavithra, a Hindu, was entitled to stay in India from May 14 to June 13, she married J Arun Kumar, a Christian, in the presence of his parents on June 4. She is presently pregnant with the expected date of delivery in March 2027. Petitioner K Pavithra Ketheesvaran, a Sri Lankan citizen, came to India in May on a tourist visa for a period of one month. She moved court seeking a direction to the authorities to register the marriage and grant her visa extension / regularisation application on the basis of the marriage solemnised / registered.
