HC disposes of Mustafa Masjid plea after MDA withdraws demolition notice
MDA had issued the notice on Aug 21 under Sections 14 and 15 of the UP Urban Planning and Development Act, 1973, alleging that around 300 sq m of the mosque, located opposite a private university on Delhi Road, had been constructed without a sanctioned map. The authority had asked the committee to submit its reply by Sept 3.
During the hearing, MDA said the notice was vague and informed the court that a fresh notice would be issued in accordance with the law, according to a copy of the order accessed by TOI. It said an inquiry team had found that relevant documents and permissions had not been produced. MDA secretary Pankaj Verma had earlier told TOI, “We have issued a notice in this regard.”
Meerut : Allahabad high court has disposed of a writ petition filed by the managing committee of Mustafa Masjid in Pakbara after the Moradabad Development Authority (MDA) withdrew its demolition and show-cause notice, conceding that the notice was vague. A bench of Justices Siddharth Verma and Kunal Ravi Singh passed the order on a petition filed by committee member Zeeshan Ahmad Farid, who had sought a stay on the proposed demolition and quashing of the notice. The notice was issued following a complaint alleging that the roadside structure lacked the requisite permissions.
The family of Fareed Jabbar, who is said to have built the mosque, had disputed the allegation, maintaining that the structure was more than 40 years old and stood on the family’s own 300-sq-yard plot. Stay updated with the latest Bareilly news.
