Mumbai special court rejects Sachin Waze's plea for NIA case diary

A special court on Monday rejected a plea by Sachin Waze, a dismissed cop and an accused in the Antilia bomb scare and Mansukh Hiran murder case, seeking directions to the National Investigation Agency to place the case diary and station diary on record.

On Feb 25, 2021, an SUV with explosives was found near Antilia, the Ambanis’ home in south Mumbai. Because he knew of the conspiracy, the prosecution has said Mansukh Hiran, the vehicle owner, was murdered on March 4. Ten accused, including Waze and another dismissed police officer, Sunil Mane, and former cop Pradeep Sharma, have been named.

The court noted that a supplementary charge sheet had been filed on Aug 10, 2026, and that the prosecution had indicated the possibility of further supplementary charge sheets.

The prosecution also said the applications were based on conjectures, suspicions and bald allegations, and that no specific prejudice had been shown. The court said, “Trial is yet to commence. In a separate application, Waze sought production of the station diary, contending that the court could peruse it if any doubt arose about the sanctity of the investigation or the bona fides of the investigating officer. The NIA, represented by special public prosecutor Sunil Gonsalves, opposed both pleas. The agency argued that Waze could not seek production of the diaries merely to examine every step taken during investigation. Special Judge Chakor S Baviskar noted that the offences in the matter were serious and sensitive, and that the investigation was still continuing. The court further observed, “…the entire Station Diary cannot be called in the Court at this stage. If required, its relevant entries can certainly be called for at appropriate stage. Rejecting the request for the case diary, the judge accepted the prosecution’s submission that the diary would be required by the investigating officer while further investigation continued. The Case Diary may not be relevant and required to be referred during evidence of each and every witness. Hence, at appropriate stage, the Case Diary can be called.”

Waze first sought a direction to the NIA to place the case diary before the court, saying timely reference to it would be necessary and desirable for a just decision.
