Nashik : A city court on Friday sentenced Sagar Shingade of Satpur to five years of rigorous imprisonment and imposed a fine of Rs 1,000 in connection with the fatal stabbing of his cousin during a quarrel around 10.30pm on August 29, 2020.
Complainant Kishan Jagtap (25) and a few friends were sitting in their locality when Shingade passed by carrying a Bluetooth speaker.
Shingade returned to the spot shortly afterwards, according to the prosecution. A request by Sunny Ghule to borrow the speaker to play songs triggered an argument, during which Shingade allegedly abused and assaulted them. When Jagtap asked him to stop, another scuffle broke out. Shingade allegedly pulled out a knife concealed at his waist and attempted to attack Ghule, who dodged the blow and suffered a minor scratch on his forehead. As the altercation escalated, Shingade’s cousin, Bhimrao, stepped in to intervene. During the melee, Shingade swung the knife at Ghule with knowledge that the act could prove fatal. Ghule ducked, but the knife struck Bhimrao in the abdomen. Though the accused had no intention of killing his cousin, the injury proved fatal and Bhimrao died.
A case was subsequently registered at Satpur police station under IPC sections 304, 326, 324, 504 and 506, along with provisions of the Maharashtra Police Act. Delivering the verdict on Friday, additional sessions judge Nandkishor L More convicted Shingade under Section 304(2) (culpable homicide not amounting to murder) and sentenced him to five years’ rigorous imprisonment with a Rs 1,000 fine. He was also convicted under Section 324 (voluntarily causing hurt by dangerous weapons) and awarded three months’ rigorous imprisonment along with a Rs 200 fine.
