Cong-backed panel challenges ordinance to appoint govt-nominated members with voting rights

HC supports returning officers on co-op bank director tenure rule

HC Kolhapur bench

The election to the chairperson post of Gokul, a Rs 3,000-crore cooperative dairy in Maharashtra, is stuck as Mahayuti alliance won 12 posts and Samavichari Aghadi won 13, both not meeting the quorum required for the election of 14 in the 25-member body. The next meeting to elect the chairperson is scheduled for Nov 10 following interim directions of the Bombay high court. When Samavichari Aghadi moved a petition in the high court against this, the court ordered notices to be issued to 12 directors of Mahayuti regarding the petition. During the hearing on Nov 2, the opposition counsel submitted an affidavit to the court stating that all directors had received the notices. Earlier, Maharashtra govt on Friday promulgated an ordinance to amend the Maharashtra Cooperative Societies Act, 1960, to appoint five govt-nominated members to the boards of federal cooperative societies with an annual turnover exceeding Rs500 crore and granted four of them voting rights.

Therefore, they have submitted their own affidavits in the high court and filed a criminal and contempt petition.

Kolhapur: The Samavichari Aghadi panel, winning 13 directors’ posts in the Gokul dairy election, on Sunday challenged in Bombay high court’s Kolhapur bench the “constitutional validity” of the ordinance promulgated on Friday allowing state govt to appoint four members to large cooperatives of federal nature with voting rights. However, in reality, three directors — Ambarishsingh Ghatge, Virendra Mandlik and Karansinha Gaikwad — did not receive any notice. The move comes amid the ongoing logjam over the election to the chairperson post of Gokul dairy.
