The division bench has ruled that the All India Trinamool Congress (AITC) has presented a viable case regarding the discrepancy in the lessee’s name, which is listed as the West Bengal Trinamool Youth Congress. The court noted that the eviction notice refers to the youth wing as part of the AITC, lending support to their claim.

Rama Devi Goenka, owner of the Camac Street building, had appealed before a division bench of Justice Sabyasachi Bhattacharyya and Justice Sandip Kumar De against a “blanket” status quo order issued for the disputed property — two floors occupied by TMC. “The trial judge will decide on the matter at the final disposal of the suit… However, the trial judge acted beyond jurisdiction in granting a blanket status quo traversing beyond the prayers made. Secondly, the trial judge was also without jurisdiction in granting an injunction till disposal of the suit, whereas the injunction application was at the ad-interim hearing stage,” the division bench held. Regarding the discrepancy in the name of the lessee, West Bengal Trinamool Youth Congress, and suit plaintiff All India Trinamool Congress , the division bench held that an arguable case has been made by AITC as even the eviction notice states the youth wing to be a unit of AITC. Kolkata: Calcutta High Court on Wednesday returned the appeal regarding an eviction notice issued to Trinamool Congress for its Camac Street office to the trial court, while directing an expedited hearing and disposal within a fortnight of the trial court’s reopening after the upcoming annual vacation.
