Prayagraj: Allahabad high court has directed all trial courts in Uttar Pradesh to ensure that execution applications in maintenance cases are decided within six months.

A single bench of Justice Praveen Kumar Giri issued a stern warning that non-compliance of the directive would amount to contempt of both the Supreme Court and the high court.

Justice Giri passed this order while dismissing a criminal revision petition filed by one Data Ram, who had challenged a Sept 2024 order passed by the principal judge of the family court in Kasganj district under Section 125 (maintenance) of CrPC. The family court had directed Ram to pay a monthly maintenance of Rs 3,000 to his wife and Rs 1,000 to each of their two minor children until they reach majority. This maintenance was payable retrospectively from April 18, 2022, the date the original application was filed.

Justice Giri in his Oct order relied on the Supreme Court ruling in Periyammal (Dead) vs V Rajamani (2025) case were the apex court had instructed all high courts to collect data on pending execution petitions and issue administrative circulars mandating six-month resolution timelines.
