Senior citizens allege illegal occupation of Motera flat — Ahmedabad

Ahmedabad : Chandkheda police have registered a land-grabbing case against four occupants accused of illegally retaining possession of a flat in Motera worth Rs 60 lakh, withholding rent amounting to Rs 5.9 lakh and threatening its elderly owners, who currently reside in Odisha.

The complainant, 44, acting under the power of attorney on behalf of her parents, filed the FIR following directions issued by the Ahmedabad district collector under the Gujarat Land Grabbing (Prohibition) Act, 2020. The couple purchased the three-bedroom flat with a terrace in a society located behind D-Mart in Motera, through a registered sale deed in March 2008, according to the complaint. In July 2023, they rented the property to the accused under an 11-month leave-and-licence agreement at a monthly rent of Rs 19,500. The occupants allegedly paid rent regularly until April 2024. However, payments stopped thereafter and they continued residing in the flat even after the agreement expired on May 31, 2024.

The complainant alleged that the accused subsequently allowed three of his relatives to occupy the flat without the owners’ knowledge or permission.

The family has also alleged that furniture and household items in the flat suffered damage estimated at Rs 4.7 lakh during the occupants’ stay. A legal notice seeking eviction and recovery of dues was issued in Nov 2024, but the dispute remained unresolved.

The accused wrote to the owners seeking additional time to vacate the premises, citing the search for alternative accommodation and family commitments, according to the complaint. Despite these assurances, the occupants allegedly neither vacated the property nor cleared the outstanding rent dues. The complaint further states that when the owners sought possession of the flat and payment of the pending rent, the four allegedly misbehaved with the senior citizens and threatened to break their legs if they returned to the property.
