New Delhi: Delhi High Court Thursday refused an urgent hearing to a YouTuber charged by Delhi Police under SC/ST (Prevention of Atrocities) Act for allegedly hurling casteist remarks and publicly humiliating a police officer during a protest near Jantar Mantar earlier this month.
Apart from SC/ST Act, the FIR against her was registered under Sections 221 (obstructing a public servant from discharging duty), 356(2) (defamation) and 3(5) (common intention) of Bharatiya Nyaya Sanhita (BNS).
Mentioning the matter for urgent hearing, the woman’s counsel said, “My interim prayer is for protection (from coercive action). Her complaint is being investigated by police’s crime branch but hasn’t resulted in an FIR. A bench of Acting Chief Justice Nitin Wasudeo Sambre and Justice Sanjay Sharma agreed to list the matter for hearing Friday. There is a strong apprehension.
Earlier, the woman had filed a sexual assault complaint against the officer, assistant commissioner of police Vivek Bhagat. That is why I request a hearing today.
Bhagat was on duty at Buta Singh roundabout near Jantar Mantar on Oct 3 when he allegedly overheard the woman making derogatory remarks about his Megh/Meghwal caste in public and questioning his appointment as an ACP, according to the FIR. However, around 3 pm, the woman allegedly accused him of sexual assault during the handling and detention of protesters and repeatedly confronted him, along with some of her colleagues, thereby obstructing his official work.
