Court Denies Interim Relief to Former BJP MLA in Gang-Rape Case
An additional sessions court in Bhiwandi has denied former BJP MLA Narendra Pawar interim relief in a gang-rape case involving police constable Shailesh Patil. The court’s decision, made on Wednesday, means that Pawar will not receive protection from the ongoing investigation related to these serious allegations.
Pawar and Patil were booked for gang rape and under sections 3 and 25 of Arms Act. Refusing to grant interim relief to the former legislator, Judge Karande observed, “Considering allegations against the accused, it is serious one, therefore, it is necessary to hear the side of the investigation as well as the victim. Pawar introduced Patil as his friend, after which the victim was taken to a farmhouse managed by a caretaker named Deva.
The complainant had approached Pawar to help resolve a marital dispute with her husband, according to details cited from the FIR in the court proceedings. Pawar subsequently moved an application for anticipatory bail seeking interim protection pending a final hearing. Pawar allegedly asked her to meet him at Kalyan’s Tilak Chowk, where Patil arrived in a car driven by him. Considering seriousness of the offence, it is not proper to grant interim protection to the applicant/accused as prayed.
The court of Additional Sessions Judge NK Karande issued show-cause notices to the investigating officer and the complainant to submit their replies on the pre-arrest bail plea on Thursday. The court has called for the say of the investigating officer, the additional public prosecutor (APP), and the victim, scheduling the matter to be heard further on Thursday.
