Justice R M Joshi rejected the anticipatory bail applications on Aug 25 while hearing the applications filed by Jahagirdar, Vitthal Kishanrao Ghodke and Ganesh Vaijnath Rukke in connection with the case registered at Ardhapur police station in Nanded district . The FIR was lodged on the complaint of Dr Atul Pawar against seven identified suspects and eight to 10 others on May 10. The police invoked 12 sections of Bharatiya Nyaya Sanhita (BNS) in the case.
The court observed that the material on record prima facie indicated “common intention and collusion” among the applicants. “According to the material placed before the court, the owners had raised objections to the alleged fabrication of the power of attorney by their close relatives. Dr Pawar had also published a public notice cautioning the public about the disputed transaction,” said Gadhe.
“Such circumstances do not support the claim of the applicants that they are bona fide purchasers,” the court observed. The circumstances, the high court observed, prima facie indicated “collusion among the applicants” in connection with the alleged attempt to grab the informant’s property. Chhatrapati Sambhajinagar: The Aurangabad bench of Bombay high court rejected the anticipatory bail applications of Manindarsingh Dharamsingh Jahagirdar alias Monty Singh and two others in an alleged Rs12-crore agricultural land grabbing case near Nanded City. The high court found that the sequence of transactions raised serious questions and prima facie indicated suspicious circumstances. It also considered the allegation that further agreements were executed despite the accused allegedly being aware of the public notice questioning the power of attorney. It also took note of allegations that Jahagirdar and another accused had visited the disputed property and asserted their rights based on agreements allegedly executed in their favour. Justice Joshi considered the prosecution’s submission that custodial interrogation was required during the investigation.
