Kolhapur Municipal Corporation to Regularise Residential Encroachments

The Kolhapur Municipal Corporation has announced a program to regularise residential encroachments established before January 1, 2011. This initiative allows for the regularisation of plots up to 500 square feet at no cost to the occupants.

Eligible cases will be published shortly, giving applicants a 15-day window to submit objections or suggestions. Once the applications are approved, the land will be classified as ‘Occupant Class-2’, with a prohibition on transfers for a period of five years.

However, not all encroachments will qualify. Plots larger than 1,500 square feet, as well as those located on riverbeds, roads, forest land, or Coastal Regulation Zone (CRZ) areas, will be excluded. Additionally, foreign nationals, individuals who have received alternative housing under the Pradhan Mantri Awas Yojana, and families applying for benefits at multiple locations will not be eligible. Importantly, a family can only benefit from this scheme once within Maharashtra.

The primary use of the land must be residential, although exceptions may be made for shops selling essential items such as groceries and medical supplies if they are part of a residential property.

Rathod ordered the regularisation under powers vested in him by the Maharashtra Land Revenue Code, 1966, following directions from the Revenue and Forest Department. KMC will accept online applications from Sept 7, with month-long special camps at all four divisional offices. Applicants will have to submit proof establishing possession before Jan 1, 2011, including voter lists, electricity bills, property tax receipts, Google Earth images, 7/12 extracts and self-declarations. Plots measuring 500-1,500 sq ft will attract a charge equivalent to 10% of the current ready-reckoner market value, while mixed-use properties will attract a 25% charge, a KMC official said.

“The committee is fully empowered and will not require separate govt approval,” Rathod said. The final approval was given at a review meeting attended by district collector Vijay Rathod and municipal commissioner Rajendra Bharud.
