Judge Questions Evidence in Assault Case
In a recent court session, a judge raised concerns regarding the lack of biological evidence in an assault case. The judge commented, “If the accused had actually dashed the victim’s head against the wall with the force alleged, the wall should have contained biological evidence, particularly human tissue.” This statement highlights the ongoing scrutiny of the evidence presented in the trial, as the absence of such evidence could impact the prosecution’s case significantly.
Court Rules Death Accidental in Motorcycle Incident
In a recent ruling, a judge concluded that the prosecution did not establish that the death in question was due to homicide. Instead, the evidence suggested the deceased likely died from accidental injuries. The judge emphasized that in cases relying on circumstantial evidence, it is the prosecution’s responsibility to demonstrate that the death was indeed homicidal.
The accused maintained from the outset that his wife had suffered injuries in a motorcycle accident. Supporting this claim, a witness testified that the accused’s father requested Rs 4,000 for her medical treatment, indicating that the couple had been involved in an accident. Additionally, medical records from Ayush Hospital confirmed a head injury consistent with a road accident.
