Former state DGP Tomin J Thachankary was sent to Thiruvananthapuram central prison after the court proceedings
A bench of Justice A Badharudeen will consider the appeal, along with his petition seeking bail by suspending the sentence imposed on him, on Sept 22. The vigilance special court, Kottayam, had on Thursday sentenced him to four years’ rigorous imprisonment and imposed a fine of Rs 30 lakh in a case in which he was alleged to have amassed wealth while serving as a senior police officer between Jan 1, 2003, and July 4, 2007. The vigilance investigation team had registered a case against him under the PC Act in 2007 and found that, during the alleged period, Thachankary had acquired and possessed assets worth Rs 64.70 lakh, disproportionate to his known sources of income by 135.80%.
The trial court, through gross misappreciation of the evidence on record and by relying merely on erroneous calculations made by the investigating officers, found him guilty of the offence punishable under the PC Act, according to Thachankary. Kochi: Tomin J Thachankary, a former state DGP who was convicted and sentenced to four years of rigorous imprisonment in a disproportionate assets case, has approached the high court with an appeal challenging his conviction and sentence. The special court subsequently convicted him in the case. He further claimed that the rental and sale income from certain properties belonging to him had been wrongly calculated by the investigating officers. He also contended that the trial court had wrongly proceeded to decide the legal right of the accused over a property that had been sold, instead of determining the fact that the sale proceeds had been credited to his bank account on the date of sale and that he had utilised the amount. Similarly, the appeal contended that the income earned by his wife from her business and agricultural properties had not been taken into consideration.
