Jayabalakrishnan, who ran a roadside eatery, was returning home on his scooter when the accident occurred, according to police.
KOCHI: A court on Thursday dismissed appeals filed by the police and the family of a scooterist seeking cancellation of bail granted to the 17-year-old son of an additional district sessions court judge, who was allegedly driving the Mercedes-Benz involved in a fatal accident at Cheranalloor.
The police are also a problem, and now the court too,” she said. “I can say that neither I nor, perhaps, anyone in Keralam has confidence in the court now. The kind of orders we have received from both courts has left us disappointed.
During the hearing, the court asked the investigating officer to appear before it and clarify whether Section 105 of the Bharatiya Nyaya Sanhita (BNS) had been invoked in any similar cases involving road accidents caused by minors.
Bhadrakeerthi said the family had expected favourable outcomes from both the trial court and the High Court but had instead faced unexpected developments. The family of the deceased, Jayabalakrishnan, expressed disappointment with the verdict. Judge Kavitha Gangadharan of the additional district court for Cases Against Atrocities and Sexual Violence Against Women and Children dismissed the appeals challenging the bail granted to the minor by the Juvenile Justice Board. Following the court’s query, the prosecution gathered details and informed it that similar action had been taken in nine previous cases.
