The accused had deliberately published videos on social media containing sexually coloured remarks, thereby outraging her modesty and seriously affecting her dignity and reputation, according to Ansiba. The court issued the order in a petition filed by Ansiba challenging the magistrate court’s order declining her plea to register a case on her complaint alleging that Lekshmipriya and the two others had circulated videos on social media containing sexually coloured remarks against her. The bench of Justice Jobin Sebastian set aside the impugned order of the magistrate court and directed it to independently examine the allegations in Ansiba’s complaint and determine whether they prima facie disclose the commission of any cognisable offences and whether a police investigation is warranted. The magistrate court shall also consider whether a police investigation is necessary to collect evidence that cannot be effectively secured by the complainant herself. Ansiba, who is also a former office-bearer of AMMA, an association of Malayalam film artists, alleged that Lekshmipriya and two others had circulated videos on social media containing sexually coloured remarks against her with the intention of tarnishing her image and subjecting her to public humiliation. However, the magistrate court declined Ansiba’s request for registration of an FIR, holding that the complaint did not disclose any cognisable offence and, at most, constituted an offence of defamation. Previously, she had approached the magistrate court alleging that the police had failed to take effective action on her complaint and seeking a directive to register a case. Accordingly, it decided to proceed with the complaint as a private complaint, directing her to appear before the court to record her sworn statement.
