Kolkata: Calcutta High Court on Wednesday refused relief to a North 24 Parganas man whose Bangladeshi wife and Indian son have been refused entry into India after authorities found she had fake voter ID, Aadhaar and PAN cards despite being on a spouse visa.
“Let the husband go and get the son,” the court said.
Justice Rao, while upholding the authority’s decision under section 7 of the Immigration and Foreigners Act 2025, also asked about the future of the son, who is an Indian national.
The single judge held that Foreigners Regional Registration Office (FRRO) had “rightly” not allowed the wife to re-enter and disposed of the case. “What will happen to the child?” the judge asked. To Prodip’s counsel, the judge said, “You knew your visa was going to expire in Sept, why did you not apply?
It was the authority’s case that the documents shown by the wife were fabricated. The single judge advised criminal action against the woman. When the counsel insisted that she be tried under Indian laws and allowed entry, the judge remarked, “You are a Bangladeshi, how can you be allowed to enter without a visa? Let your husband go and get the son. But you cannot be allowed.”
