Infosys filing to SEC: Facing investigation from Department of Justice on classification of H-1B visa employees in immigration documents

In its financial statements for the quarter and half-year ended September 30, 2026 with the Securities and Exchange Commission (SEC) filing, the company said it could not predict the outcome of the investigation. In its annual filing for the financial year ended March 31, 2026, Infosys said that it is under investigation by the Justice department over the classification of certain H-1B visa recipient employees working for one of its clients in immigration documents filed with US govt authorities. The company has previously faced similar probes in 2013 when Infosys agreed to pay $34 million (Rs 215 crore) in penalties to settle alleged visa fraud and I-9 paperwork errors under investigation by the US Department of Justice. Similarly, in 2017, Infosys reached a $1 million settlement with New York State over failure to compensate hundreds of workers brought in on work visas and to pay applicable state taxes. The company said the agreement concluded New York State’s investigation relating to taxes paid in 2010–2011, without any criminal or civil charges being filed.

Infosys has also not revealed whether the DOJ alleges fraud, misrepresentation or any other violation.

Infosys has said that it is in talks with the US Department of Justice about how the company classified certain H-1B visa employees in immigration documents filed with certain US government authorities. Department of Justice (“DOJ”) is conducting an investigation regarding how the Company classified certain H-1B visa-recipient employees in immigration documents filed with certain U.S. government authorities,” the SEC filing says, adding “The Company is engaged in discussions with the DOJ regarding its ongoing investigation and continues its own inquiry regarding the matter”. “At this stage, the Company is unable to predict the outcome of this matter, including whether such outcome could have a material adverse effect on the Company’s business and results of operations,” the company states. It says only that the investigation relates to how certain H-1B employees were classified in immigration documents filed with US government authorities.
