A new fence triggered a dispute over just one foot of land
A dispute over a fence and roughly one foot of land between two neighbouring homes in Poole, Dorset, grew into a five-year legal battle that left 77-year-old Jenny Field facing a £113,266 bill. The original case was decided in favour of her neighbour, Pauline Clark, in 2022, but repeated attempts to challenge the judgment pushed the costs into six figures. The court ultimately ordered Field’s £420,000 home to be sold to settle the debt. The case reached court, and Clark won in 2022, according to The Telegraph. Field was ordered to pay about £14,000, including damages and legal costs. The Telegraph also reported that Field’s legal liability eventually reached £113,266, many times the original sum awarded after the 2022 judgment. Field had bought the bungalow for £270,000 in 2016, but it was valued at around £420,000 at the time of the ruling The court regarded the sale as a last resort after Field had been given opportunities to resolve the debt.
The judge said the matter needed to reach an end and that the parties needed to find a way to put the dispute behind them. What had begun as a dispute over a narrow strip of land was far from over. The continued litigation caused the amount she owed to increase dramatically. At a later hearing, District Judge Ross Fentem described the dispute as a long-running case in which Field had sought to relitigate the original proceedings. With the debt still unpaid, the court eventually turned to Field’s property as a means of recovering the money. The judge ordered that her home should be sold to cover the outstanding costs. Field did not accept the conclusions reached against her and continued to challenge the proceedings.
