Nagpur: Taking a stern view of not just air and noise pollution caused by firecrackers, but also risk of injuries to people, the Nagpur bench of Bombay high court on Tuesday reiterated that bursting firecrackers on public roads and streets will not be permitted in the upcoming Diwali celebrations in the city.

It also sought clarity on safety norms and conditions governing 279 licences issued to firecracker sellers. Reiterating its September 23 order, the court maintained public roads and thoroughfares cannot be used for bursting firecrackers during festivals. The court also questioned the police administration on action against wholesalers, retailers and buyers involved in sale and purchase of firecrackers generating noise exceeding 55 decibels. The matter will be heard again on November 4.

The court directed police to ensure strict compliance with the order and sought an affidavit detailing its action plan to curb violations. A division bench of Justice Urmila Joshi-Phalke and Justice Raj Wakode was hearing public interest litigations concerning noise pollution. The bench also emphasised that only green firecrackers should be used, while making it clear even these cannot be burst in public spaces. The police commissioner and other concerned authorities were directed to take necessary steps to prevent violations and ensure compliance with Supreme Court guidelines. The police administration submitted its response affidavit, but the court expressed dissatisfaction with details provided and directed the appointment of special officers to monitor compliance with licensing conditions on the ground. Advocate Abdul Subhan appeared as amicus curiae. Advocates Ashutosh Dharmadhikari and Tushar Mandalekar represented the petitioners, while advocate N S Rao appeared for the state govt.
