Agra : A special Pocso court in UP’s Kasganj has sentenced a 30-year-old man to 20 years’ rigorous imprisonment for sexually assaulting a four-year-old girl after luring her with a toffee and taking her to a field in July 2022. Special judge (Pocso) Dhannjay Kumar Mishra convicted Ajay Kumar Singh alias Pintu alias Ravi under IPC section 376 (rape) and Pocso Act , and imposed a fine of Rs 5,000. The crime took place around 10am on July 12 in a farm about 125m from the child’s house at a village in Kasganj, according to the special public prosecutor. In her statement before the court, the four-year-old described how she was taken away by the man and also identified her statement recorded under CrPC 164.
The court noted that the child’s medical tests found “an internal injury to her genital area with bleeding and a ruptured hymen”. The survivor’s testimony played a key role in nailing the convict. The court ordered that the penalty amount be paid to the child. The accused, who had come to the village as a labourer for boring a submersible pump, lured the child and violated her. He was arrested the next day. The medical evidence was considered alongside the child’s statement recorded before a magistrate.
Court Upholds Prosecution Evidence in Child Abuse Case
In a recent ruling, the court affirmed the prosecution’s case in a child abuse trial, citing forensic evidence that included male-specific alleles found in samples collected from the survivor. Despite the defense’s attempts to undermine the prosecution by pointing out inconsistencies in witness statements, delays in filing the First Information Report (FIR), and questions about the location from which the child was taken, the court found these arguments insufficient to discredit the prosecution’s evidence. As a result, the court delivered its sentence on Friday.
