Court Denies Bail to Security Guard Linked to Fatal Drug Overdoses
A special NDPS court in Mumbai has denied bail to Pradeep Gupta, a security guard accused of facilitating access to drug suppliers at a recent event. The court’s decision came after Gupta was implicated in the distribution of 933 ecstasy MDMA pills, weighing a total of 435 grams, which resulted in two fatal overdoses at a Goregaon event.
Special judge RK Deshpande emphasized the severity of the case, stating, “Admittedly, due to consumption of said contraband, already two persons lost their lives.” The judge noted that the gravity of the offence, the quantity of drugs involved, and the deaths of two individuals warranted the denial of bail, despite the chargesheet being filed.
Gupta was arrested on April 13, following alleged offences that took place between April 11 and April 12.
“Because of the invalid entry, co-accused have sold Ecstasy MDMA pills in the said concert.
Even on the date of event, there were exchange of phone calls between applicant and aforesaid two accused persons,” the judge said.
Court Reviews Gupta’s Bail Plea Amid Ongoing Investigation
The court has reviewed the bail plea of Gupta in light of new developments, specifically the filing of the chargesheet. The defence argued that Gupta was not involved in the collection of consent forms from event guests, which stated that attendees would be responsible for any illegal activities, including drug use and possession of prohibited beverages. According to the defence, these forms were collected by Nesco through a ticketing partner, and Gupta had no direct role.
The defence also contended that Gupta’s arrest was unlawful, asserting it was based solely on suspicion. They emphasized that the investigation had concluded with the submission of the chargesheet. Notably, the court had previously rejected Gupta’s bail plea on its merits, with the only change being the recent filing of the chargesheet.
