Ahmedabad: Gujarat High Court on Monday granted seven-day bail to Aam Aadmi Party (AAP) MLA from Dediapada, Chaitar Vasava, so that he can attend monsoon session of the state assembly from Sep 9 to 11.
Vasava was sentenced to seven years’ rigorous imprisonment by a sessions court at Rajpipla in June along with his wife and seven others in connection with a 2023 case of assault on forest officials and extortion. Last week, Vasava filed an application and requested HC to grant him parole so that he could attend the assembly session. It said, “An order suspending the sentence and enlarging the accused on bail may create a perception in the society that persons in power are beyond the reach of law and may commit offences without fear of legal consequences. Justice Vimal Vyas granted bail to Vasava on the conditions of not leaving Gandhinagar , attending the assembly session and not interacting with the media. His bail period will run for seven days from his actual release. He is lodged in Vadodara central jail. Vasava had sought bail by citing govt notification regarding the assembly session and the invitation issued to him under the assembly rules. The state govt opposed the bail plea as well as the bail period, arguing that the assembly session was only for three days. He, however, withdrew the application after HC questioned the maintainability of the parole application without first approaching the prison authorities for the same. Last month, HC admitted Vasava’s appeal against his conviction but refused to suspend his sentence. Vasava’s application to stay his conviction is pending in HC. As he was sentenced to seven years’ imprisonment, Vasava faces disqualification as a legislator as well. Download the TOI App.
