Opposition Excluded from AMC Committees, Claims Corporator
Ilyaskhan Pathan, a corporator representing Khadia, has filed a petition alleging that the BJP-led Ahmedabad Municipal Corporation (AMC) fails to include opposition members in its 28 committees. Pathan’s legal representative pointed out that the BJP holds 160 of the 192 seats in the AMC, leaving 32 councillors in the opposition. According to the petition, this exclusion effectively sidelines opposition councillors, as only members of the ruling party occupy significant positions within these committees.
Govt pleader G H Virk, who appeared for mayor Hitesh Barot, raised objection that the governing law did not mandate inclusion of councillors belonging to opposition parties on the committees in question. He argued that the petitioner had identified neither an enforceable entitlement to committee membership nor a corresponding legal obligation requiring mayor or corporation to provide the representation demanded. The petitioner’s lawyer cited the provision of section 31A of the Bombay Province Municipal Corporation Act and submitted that the law was adapted by Gujarat as the Gujarat Provincial Municipal Corporation Act. However, the govt pleader underscored that this specific provision does not find a place in the GPMC Act.

After the hearing, Justice Pranav Trivedi dismissed the petition and said a reasoned order would follow, Virk said. Download the TOI App.
