New Delhi: Delhi High Court has flagged the alleged tampering of one of its orders when it emerged that an extra line “interim stay granted” was added to it even though the original verdict carried no such relief.
Justice Purushaindra K Kaurav was hearing a petition by Meena Devi and another petitioner who complained about police inaction over their allegations of fraud and forgery relating to a 175-square-yard plot in the extended Lal Dora area of Khera Khurd village in Delhi.
The court said: “Some unknown person seems to have fabricated the order passed by this court and added a para containing the words ‘interim stay granted’. The said aspect requires to be investigated and appropriate action has to be taken”. During arguments, their counsel relied on a court order carrying the “interim stay granted” line. The high court said the matter warranted appropriate follow-up action.
One of the parties in a property dispute cited the order to allege non-action by police.
But when the judge cross-checked with the original records, there was a discrepancy between the order that was passed on that date and the copy produced before the court. The order on the earlier date merely recorded that counsel for the respondents had sought time to take instructions and listed the matter for the next date, calling for the trial court’s records to be requisitioned.
