Hyderabad: Telangana high court has dismissed a writ petition challenging ownership over a 3.13-acre temple land at Konkapaka in Warangal district, ruling that the land belongs to Sri Hanuman Devalayam.

Justice EV Venugopal has recently dismissed the petition filed by a group of individuals, who sought cancellation of the pattadar passbook and title deeds issued in the temple’s name and sought restoration of their names as owners and pattadars.

Govt counsel, however, submitted that the land had been classified as endowment land in 2007 under the Inams Abolition Act and consequential revenue entries were made in favour of the temple. The petitioners claimed that their grandfather was the original inamdar of the land and that the property had devolved upon them. They contended that their names were reflected in the revenue records and that they remained in possession until the entries were allegedly altered by the then village revenue officer. They alleged that the land was subsequently recorded in the name of Hanuman Devalayam without notice or an opportunity of hearing. The counsel argued that the petitioners had failed to produce an occupancy rights certificate, inam fair register, title deed or other legally admissible documents establishing their rights. Revenue authorities also contended that they were not in physical possession and that the land was lying vacant.

The court observed that the petitioners had not raised objections despite the temple’s name appearing in the pahanies since 2007. Assistant govt pleader for endowments department Mangilal Nayak said the temple was registered under the Endowments Act and that any title dispute had to be decided by the endowments tribunal. It found that the challenge was made after a considerable delay and without a cogent basis, and dismissed the petition. Download the TOI App.
