Hence, the petitioner moved court seeking a direction to the state to fill up existing vacancies, assess the need for additional posts, improve district-level coverage, establish suitable supervision and aftercare mechanisms, and consider the recommendations of the National Human Rights Commission arising from the National Consultation on the implementation of the Probation of Offenders Act, 1958. The petitioner stated that probation officers are required to prepare enquiry and social investigation reports, conduct field visits and residence verification, supervise probationers, undertake rehabilitation and aftercare and coordinate with courts, families and government agencies. Their responsibilities also include inquiries relating to leave and premature release, prison visits, police-lock-up inspections, victim compensation, prisoner welfare, Discharged Prisoners’ Aid Societies and other correctional functions. These duties cannot effectively be performed by a severely understaffed establishment. The petitioner also sought a direction to the state to conduct a comprehensive and time-bound review of the existing sanctioned strength, vacant posts, working strength, district-wise deployment, workload, court-wise requirement and present functions of the Probation Wing, and take a reasoned decision regarding filling up of vacancies and creation and restoration of posts. He further sought a direction to ensure that the wing was made practically accessible and functional at district and major court levels, with adequate field support, travel facilities, office infrastructure, supporting staff and proper coordination with courts, prisons, District Legal Services Authorities and rehabilitation agencies concerned.
