Kerala HC issues notice to EC, MLA Mani C Kappan — Plea for disqualification

A bench of Justice Bechu Kurian Thomas further sought instructions from the Speaker of the state assembly and the state govt, and adjourned the petition to Sept 22 for a detailed hearing. The additional metropolitan magistrate court, Borivali, Mumbai, had convicted and sentenced Kappan to three-and-a-half years’ imprisonment in four cheque cases involving Rs 3.25 crore, filed by Menon on Sept 1, according to Menon. Later, on Sept 9, Menon emailed a representation to the Speaker informing him of Kappan’s conviction and seeking to have him declared disqualified from continuing as a member of the legislative assembly. However, the Speaker’s private secretary informed him that the Speaker would return to Thiruvananthapuram only on Sept 28, prompting him to approach the HC seeking Kappan’s disqualification on account of his conviction and sentence.

Kochi: The high court on Monday issued notice to the Election Commission and Mani C Kappan, MLA in a petition filed by Dinesh Menon of Mumbai seeking to disqualify Kappan from continuing as an MLA from the Pala constituency following his conviction and sentence to three-and-a-half years’ imprisonment in four cheque cases.
