Victim’s kin raise suspicion of evidence destruction, seek fresh FIR — Cheranalloor accident

The emergence of CCTV footage has added a fresh dimension to the case

Kochi : The daughter of Jayabalakrishnan, who was killed in a road accident in Cheranalloor allegedly caused by the minor son of a judge, has approached the city police demanding registration of a separate criminal case alleging there was suspicion that the father of the minor destroyed evidence at the accident spot and attempted to derail the investigation.

The complaint adds that the opposite party is a sitting additional district judge under the control of the high court and he went to the police station violating rules, influenced police officers, and interfered with the independent investigation of the police, thereby committing a violation of law.

The complaint by the victim’s daughter, Bhadrakeerthi RJ, alleges that she has come to know that the father of the minor reached the accident spot 20 minutes after becoming aware of it. The complaint alleged that he spent approximately three hours there.

The complaint demands an investigation under applicable sections, including BNS Section 238 for causing disappearance of evidence of offence, or giving false information to screen offender.

The complaint says that it needs to be investigated whether there has been an obstruction in finding out the actual circumstances of the accident and gathering evidence regarding the involvement of the driver. It added that the investigation against his own actions cannot be avoided merely by considering the fact that the child involved in the accident is a minor and that the said person is the child’s father. It alleged that his prolonged presence at the accident spot and the activities that took place in the interim must be subjected to a serious investigation. If evidence has been destroyed or false information provided with the intention of rescuing the child from legal proceedings, it is an independent offence, the complaint adds.
