Lucknow: The Allahabad high court’s Lucknow bench has asked the state govt to consider framing a clear policy and parameters for determining compensation in incidents other than natural calamities, observing that payment of different amounts in different cases could lead to discrimination and arbitrariness.
This included Rs 5 lakh from the Chief Minister’s Discretionary Fund, Rs 4 lakh from the State Disaster Response Fund and Rs 2 lakh from the Prime Minister’s Relief Fund. However, the bench was informed that some families had not yet received the Rs 2 lakh assistance from the Prime Minister’s Relief Fund.
Court Orders State to Develop Compensation Policy for Injured Parties
The court has mandated that the state create a compensation policy for cases not currently addressed by existing laws. During the proceedings, advocate Apoorva Tewari highlighted three Supreme Court rulings, arguing that in the absence of a specific policy or statutory guidelines, compensation principles from motor accident claims should be applied. Additionally, the court ruled that the state must cover the medical expenses for the injured youth involved in the case.
