KMC to regularise pre-2011 residential encroachments: The wider industry impact

The Kolhapur Municipal Corporation has announced a new initiative to regularise residential encroachments that occurred before January 1, 2011. Under this programme, residential plots measuring up to 500 square feet will be regularised at no cost to the owners. This move aims to address longstanding issues related to unauthorized constructions in the area.

Eligibility Criteria for Land Registration Announced

A forthcoming list of eligible land cases will be released, allowing applicants a 15-day window to submit objections and suggestions. Upon approval, the land will be designated as ‘Occupant Class-2’, with a five-year prohibition on transfers.

Certain plots will be deemed ineligible, including those exceeding 1,500 square feet and any encroachments on riverbeds, roads, forest land, or Coastal Regulation Zone (CRZ) areas. Additionally, foreign nationals and beneficiaries who have already received alternative rehabilitation under the Pradhan Mantri Awas Yojana will be excluded. Families can only benefit once across Maharashtra.

The primary use of the land must be residential. However, in exceptional cases, small shops selling daily necessities, like grocery and medical stores, may be permitted if they are part of a residential property.

Rathod ordered the regularisation under powers vested in him by the Maharashtra Land Revenue Code, 1966, following directions from the Revenue and Forest Department. KMC will accept online applications from Sept 7, with month-long special camps at all four divisional offices. Applicants will have to submit proof establishing possession before Jan 1, 2011, including voter lists, electricity bills, property tax receipts, Google Earth images, 7/12 extracts and self-declarations. Plots measuring 500-1,500 sq ft will attract a charge equivalent to 10% of the current ready-reckoner market value, while mixed-use properties will attract a 25% charge, a KMC official said.

“The committee is fully empowered and will not require separate govt approval,” Rathod said. The final approval was given at a review meeting attended by district collector Vijay Rathod and municipal commissioner Rajendra Bharud.
