The order had debarred them from practising for 13 months for accepting and visiting foreign shores on a company-funded trip. Ahmedabad: Gujarat Medical Council (GMC) has approached Gujarat High Court seeking to lift the stay the court granted on GMC’s order suspending three dermatologists.
On June 30, GMC suspended Dr Jagdishkumar Sakhiya and Dr Ami Shah from Surat and Dr Geeta Patel from Ahmedabad. They were among 30 Indian doctors accused of going to Monaco and Paris on a company-sponsored junket in 2024, which is prohibited under the council’s rules. The doctors challenged the order removing their names from the GMC register from Aug 30, 2026 to Sept 29, 2027, and claimed they had attended training sessions on anti-ageing treatment held by a multinational company. They argued that Rule 79(3) says that GMC cannot entertain any anonymous complaint.
Dr Sakhiya is the president of Indian Association of Dermatologists, Venereologists and Leprologists (IADVL). An anonymous complaint before National Medical Commission (NMC) set the ball rolling, and GMC was tasked with inquiring into and taking action against the three doctors. Corporate rivalry may have prompted an anonymous complaint before NMC. Last month, HC stayed GMC’s order ex parte. GMC filed an application to vacate the stay, submitting that the anonymous complaint was made to govt department and not to GMC, which only probed the issue at NMC’s behest. Its lawyer submitted that the doctors have the option to approach NMC’s Ethics and Medical Registration Board (EMRB) against GMC’s decision. The doctors’ counsel submitted that it was EMRB that ordered GMC to conduct the proceedings.
After the hearing, HC adjourned the case for a week and ordered that the automatic lifting of the ex parte stay after 14 days under Article 226(3) would not apply until then.
