Karnataka high court
Kannambadi Kumar, the complainant, alleged that on Dec 18, 2022, there was a protest by a group of people, claimed to be the supporters of BJP, and, those who had assembled raised ‘Pakistan Zindabad’ slogan. Justice Srishananda, citing similar cases wherein the slogan ‘Pakistan Zindabad’ was intentionally raised, pointed out that the high court had held that prior sanction is necessary for initiating action for the offence punishable under Section 505 IPC. On seeing such a video in 2024, the complainant claimed that he was disturbed mentally and therefore sought action by police.
Bengaluru: The high court has quashed the proceedings initiated against a resident of Mandya district accused of raising a pro-Pakistan slogan, observing that in a demonstration organised by Bharatiya Janata Party (BJP), it is highly unimaginable that the protesters therein would raise the slogan ‘Pakistan Zindabad’. DS Ravi Kumar is the petitioner.
Justice V Srishananda has also pointed out that the complaint itself was filed after a lapse of nearly two years based on a video clip circulated on YouTube and that the investigation officer has not obtained the sanction mandated under Section 505 of the IPC.
