The court was told that officials are having a relook at the circular which is being challenged. Compulsory disclosure of such information, as mandated in the circular, could expose confidential commercial arrangements and may also cause confusion among patients, according to the petitioners. Recording the submission, Justice CM Poonacha adjourned hearing on the petition filed by Private Hospitals and Nursing Homes Association and others. The petitioners argued that the circular was issued without consulting stakeholders and without any statutory authority and imposes a disclosure obligation that is not contemplated under the existing legal framework. They contended that procurement prices vary depending on suppliers, discounts, rebates, credit arrangements and other commercial terms. Download the TOI App.
