After hearing both sides on Tuesday, the court reserved its order

Justice A Badharudeen was considering a 2020 petition filed by M S Anil of Cherthala seeking a vigilance probe into the alleged microfinance fraud. The court had sought the state govt’s view on the issue during the previous hearing and heard the matter in detail on Tuesday.

Previously, counsel for the petitioner had argued that the accused persons were public servants as defined under Section 2(c)(xii) of the PC Act. The court also orally asked whether the Vigilance and Backward Classes Development departments had different views on the matter. In reply, the state attorney clarified that the definite stand of the state govt was that no prosecution sanction was required in the cases.

Meanwhile, the Court noted that the vigilance investigation team had previously submitted that the final reports in cases related to the alleged microfinance fraud had been forwarded to the state govt seeking prosecution sanction under the PC Act. After hearing both sides on Tuesday, the court reserved its order.
