Kochi/T’puram : The high court has directed the state police chief to hand over to a crime branch special investigation team (SIT) the probe into the alleged medical negligence during a complex cosmetic surgery performed on a 31-year-old software professional from Muttathara at a private daycare hospital at Kazhakootam in Thiruvananthapuram . A bench of Justice G Girish also directed the SIT to complete the investigation within six months. The court was considering a petition by the woman seeking a transfer of the case, registered at Thumba police station on her complaint, to a crime branch SIT. She further alleged that the consequences of the surgery had deprived her of her livelihood, leaving her unfit to pursue her career in the software sector. the court observed that the hospital, registered only as a daycare centre, was ill-equipped to perform such a complex procedure While considering the petition. It noted that undertaking such a surgery at a daycare facility amounted to an abhorrent violation of medical protocol, with scant regard for the patient’s health, safety and well-being. Directing the transfer of the investigation to an SIT, the bench asked the team to examine whether a plastic surgeon exercising ordinary prudence would undertake such a complex procedure at a day surgery centre. The investigation must also examine the circumstances surrounding the surgery and the alleged lapses in medical care.
