It said the appeals would be considered if the defects were rectified by 3.30pm. The single bench had on Oct 9 directed the vigilance director to register a case against Vijayan and his family members based on recommendations made by the Enforcement Directorate (ED) to the state police chief. Kochi: Former chief minister Pinarayi Vijayan , his daughter Veena T and son-in-law and former minister P A Mohamed Riyas have approached the high court with appeals challenging a single bench order directing the vigilance director to register an FIR against them in the alleged CMRL-Exalogic pay-off case. During the proceedings, the appellants argued that the impugned order had been issued without giving them an opportunity to be heard. The bench then asked whether persons facing allegations needed to be heard before a case was registered. However, the appeals were later adjourned to Tuesday as the defects had not been cured within the stipulated time. The single bench also set aside the state police chief’s order constituting a special investigation team (SIT) to conduct a preliminary inquiry into the materials provided by the ED instead of registering a case.
