Khata conversion

Issued by the revenue department, the Sept 9 order will remain in force until Dec 31, 2027. The mechanism covers plots, sites or land measuring up to 1,000 square metres within the jurisdiction of urban local body or gram panchayat. Bengaluru: Weeks after the Karnataka cabinet approved proposals to enable conversion of eligible ‘B’ Khata properties into ‘A’ Khata, the state govt has issued a formal order authorising the urban development department (UDD) and rural development and panchayat raj (RDPR) department to implement the mechanism. The property must have already been put to the proposed non-agricultural use, regardless of whether prior permission for change of land use or conversion was obtained. The proposed use must be permissible under the applicable Master Plan or zonal regulations, or otherwise admissible under relevant town and country planning provisions. The order designates officers in urban and rural local bodies to collect conversion charges, regularisation fees and penalties and issue ‘A’ Khata within their respective jurisdictions.

In rural local bodies, properties assessed or recorded as ‘B’ Khata on or before April 7, 2025 will qualify. In urban local bodies, properties with a ‘B’ Khata issued on or before Sept 10, 2024 will be eligible. Properties exceeding 1,000 square metres will not qualify.

A property falling within the boundary of B-Kharab land will be ineligible for “A” Khata. In urban local bodies, the chief officer of a town municipal council or town panchayat, commissioner of a city municipal council and zonal commissioner of a municipal corporation will exercise these powers. In rural areas, the panchayat development officer of the gram panchayat will be the prescribed officer. The benefit will not extend to properties forming part of govt land, B-Kharab land, forest land, gomal land, tanks or tank-beds, rajakaluves, nalas, roads, road margins or land reserved for public purposes. Properties facing acquisition proceedings, court or tribunal stays, govt restrictions or violations of applicable Master Plans, Zonal Regulations or land-use restrictions will also be excluded. Separate provisions have been laid down for A-Kharab and B-Kharab land. Where a portion of the property falls within A-Kharab land, the applicant must obtain permission from the competent revenue authority. If only a portion contains B-Kharab land, a survey sketch will be mandatory and the portion outside the B-Kharab boundary may be considered for ‘A’ Khata. The revenue department will facilitate digital verification of applications. The prescribed officer will have access to the latest RTC, A- and B-Kharab details, ownership and mutation records, rights and liabilities, tenancy and crop details, Akarbandh, govt flags or restrictions, and auto-calculated conversion charges, regularisation fees, penalties and other statutory dues. After verifying the records and establishing eligibility, the officer will collect the applicable conversion or compounding charges, regularisation fees and penalties and deposit them under the revenue department’s head of account. Properties without an existing Khata record will also be covered if a transaction was effected through a registered deed before the cut-off date. Properties that existed before the cut-off date and are otherwise eligible to obtain ‘B’ Khata will also be covered.
