A Thane Sessions Court has acquitted a 34-year-old constable of the Maharashtra Security Force (MSF) who faced multiple serious charges, including rape, causing miscarriage without consent, cheating, and criminal intimidation. The constable had spent 35 days in jail in 2020 while awaiting trial. The court’s decision comes after a review of the evidence presented in the case, ultimately leading to the dismissal of all charges against him.
The accused and the woman, both MSF personnel, became acquainted in 2018 and entered into a relationship, according to the prosecution. Additional Sessions Judge GT Pawar pronounced the judgement in a case arising from an FIR. The woman alleged that he established sexual relations with her after promising to marry her. She later became pregnant, and the prosecution alleged the pregnancy was terminated in Solapur. The judge observed that the couple had been in a relationship for one-and-a-half years and continued having sexual relations even after she allegedly learnt that the accused’s marriage had been fixed with another woman. The prosecution failed to examine the doctor who allegedly performed the medical termination of pregnancy. There was insufficient evidence to establish that the miscarriage was caused without her consent. On the cheating charge, the court held the prosecution failed to establish that the accused had deceived the woman.
However, the court found significant contradictions in the woman’s earlier complaints, FIR and testimony.
